Prof. Cherkeh and Heyn on the publication of doping awards on NADAjus

SpuRt issue 6/2020: „Veröffentlichung von Doping-Schiedssprüchen mittels der Datenbank NADAjus – aus insbesondere datenschutzrechtlicher Sicht“ ("Publication of doping awards by means of the NADAjus database - from a data protection law perspective in particular")

Since June 01, 2020, NADA does not include any new arbitration awards or any new short entries in the NADAjus database. The background to this is the complaint addressed to the State Commissioner for Data Protection and Freedom of Information of North Rhine-Westphalia by an affected athlete who feels that his rights have been violated by the publication of the "wanted poster" and the DIS arbitration award on the NADAjus database and has therefore taken action against NADA's publication practice by means of the above-mentioned complaint.  The complaint proceedings of the athlete represented by KERN CHERKEH Rechtsanwälte PartmbB are currently pending.

 

In the current issue of SpuRt (issue 6/2020), Cherkeh and Heyn deal with the publication practice of sanctioning doping awards. They also point out possible solutions to ensure that the fundamental rights of athletes are not disproportionately restricted in favor of the fight against doping.
